Personal Injury Settlement Amounts
You have probably heard a lot about personal injury settlement amounts whether you knew that was what they were called or not. For example, when you are watching the news and you hear about a woman winning millions of dollars because a hot coffee from a fast food restaurant spilled on her then you are hearing about personal injury settlement amounts. The plaintiff is the individual who files a lawsuit requesting money to make up for some wrongful injury. The amount that is demanded may be an arbitrary number, but sometimes it actually reflects the amount of damage that was done. When it comes to receiving a settlement, however, what the plaintiff demanded may or may not be award. The reason why is that a settlement only includes the insurance agency and attorneys. This means that for a settlement to be offered they must come up with a number similar to what a jury would in order to settle the matter. Otherwise the suit could go to court and cause serious problems for the company/individual at fault.
Most attorneys who have worked with lawsuits of this nature for some time are quite aware of what a jury would more than likely offer in any particular suit. So, it is up to the attorney to help the client settle for an appropriate amount considering the damage and injury incurred as well as any reimbursement for missed work, disability, and more. Once a settlement amount is decided upon it is up to the plaintiff to accept it in lieu of going to court.
Some other issues that affect the settlement amount include hospitalization and medical bills and whether or not the individual will be able to work again in the future in the same capacity. If not lost wages for the rest of the individuals life may be included in the settlement offer. There is no way to determine what the average personal injury settlement is and apply it to all situations because it doesnt work like that. All cases are considered on the facts of that particular case and then a personal injury settlement is offered. For example, some people may win a settlement of $500 for a suit where nothing major happened but it was taken to court anyway. Other settlements reach into the millions when an individual is disabled, dismembered, or left with the inability to work.
There are all kinds of personal injury settlement amounts that range form a small amount of money to a very large amount of money. The only way to get a settlement is if the situation warrants a settlement. For example, something occurred and the insurance company does not wan it getting out on the street is often hidden with a settlement. Other times when the insurances company is especially worried about the case going to court a nice settlement is offered to keep that form happening. One thing is for sure and that is with a personal injury settlement a whole lot of time is saved for both parties.
