Statute Of Limitations - How Does This Provision Affect Your Case?
The statute of limitations affects your case a lot. Once you allow the statute of limitations to expire without filing your lawsuit, you lose all rights to file any claim for any type of vehicle accidents you became a victim.
When you are faced with the reality of having to file a lawsuit, you must learn that there are deadlines that might prevent you from starting one.
Like any other personal injury claim, there are always important deadlines to be met. Every year, many people failed to get the compensation for damages they deserve because they have put off contacting a lawyer too long.
The statute of limitation is applied in every wrongful death and other personal injury claims. This provision of the personal injury law limits the time when you need to file for a lawsuit on your personal injury claims.
Once you let the time frame indicated in the statute of limitations expire without having your lawsuit filed, it is equivalent to foregoing your rights to take legal action on your claim. Consequently, it also means giving up all hope to obtain compensation for damages from the responsible party that initiated your injuries.
Some cases have six months statute of limitations beginning on the date when the accident happened. Thus, it is a vial issue to start processing your case as soon as the accident occurred. Sometimes, though, it may take you several months to classify all the companies or individuals who are liable in your claims.
Thus, obtaining competent legal services from a well-versed or experienced vehicle accident attorney as early as possible has a critical importance in your personal injury case. If you or a family member has been victims of a vehicle accident, especially serious and fatal ones, and sustained injuries that were not your fault, you must consult a lawyer immediately.
Furthermore, you must also know that your actions in the scene of the motor vehicle accident have a great implication on your personal injury case. Know that whatever you do may make the difference between winning and losing your lawsuit case. You must know what to do and what to avoid during such incidents.
If you are quite panicky and do not know what to do, contact your lawyer right away. He or she could advice you about the rules you need to follow at the scene of the incident.
- Inform the police as soon as possible.
- Unless you are instructed by the police from doing otherwise, do not leave the location of the accident.
- Talk about your accident and the injuries you sustained only to the police and some medical personnel.
- Never admit any fault
- On a piece of paper, write down the names, resident addresses and the phone numbers of the people involved in the accident and also the witnesses. Remember that witnesses have profound importance in how a lawsuit comes out.
Moreover, write down the license and state plate number of the vehicles involved.
- If you believe you have been injured, seek medical attention right away
You may be contacted by some investigator of insurance company claims representative immediately or so soon after an accident occurred. Do not fall for the encouraging and sympathetic speeches they have. As long as you entertain them, you will be kept from hiring a lawyer and you may be coerced on a settlement that is cheaper and is not what you deserve.
Whatever they may say about their services and how it best suits you, they are not there to help you. They are there to make you forget the statute of limitations for your case and delay your filing of a lawsuit charge.
